Lewis-Clark State College has long been committed to compliance
with Section 504 of the Rehabilitation Act and to providing educational access
to persons with Disabilities.
Section 504 of
the Rehabilitation Act of 1973 provides:
“No otherwise
qualified, handicapped individual in the United States shall solely, by reason
of his handicap, be excluded from the participation in, be denied the benefits
of, or subjected to discrimination under any program or activity receiving
federal financial assistance.”
The
Americans with Disability Act was enacted in 1990. Section 202 provides:
“No qualified
individual with a disability shall, by reason of such disability be excluded
from the participation in or be denied the benefits of the services, programs or
activities of any public entity, or be subject to discrimination by any such
entity.”
After admission to LCSC, students who self-identify and provide
appropriate documentation of a disability to the Coordinator for Disability
Services may qualify for services. Documentation should include a
diagnosis, prognosis and restrictions or limitations that the disability might
dictate.
A
“qualified individual with a disability” is an individual who has a
physical, mental, or sensory impairment that substantially limits one or more
major life activities; has a record of such impairment, or is perceived to have
such impairment.
A
person is an “individual with a disability” if he/she:
a) has a disability;
b)
has a record of a
disability;
c) is regarded by
others to be disabled.
