What is Covered by LCSC's Liability Coverage?

The following is a brief overview of the types of coverage in the State liability program:

General Liability - provides for liability protection for bodily injury and property damage arising out of routine operations of State government, sale of products, building and premises operations and contractual assumption of liability.

Automobile Liability - provides coverage for all State-owned and State-leased vehicles license for road use and also provides the State's protection for various liabilities arising out of the operations of non-owned vehicles.

Liability coverage is also provided for Personal Injury Liability, Errors and Omissions Liability and Medical Malpractice Liability coverage (for applicable State entities and programs).

Common exclusions of the State's Liability Coverage include: · Claims arising from intentionally injurious or malicious acts of employees or volunteers · Acts of employees outside the course and scope of employment · Claims for recovery of wages, salary, benefits and related items · Claims involving breach of contract · Fines or penalties, including punitive damages · Claims for inverse condemnation or eminent domain · Claims for injunctive relief or declaratory judgment · Attorney fees awarded in an action were coverage is not otherwise provided

Who is Covered?

The State of Idaho, any agency (including State Colleges) of the State, State public health districts, any other entity under the State's control for which it assumes active management, employees, authorized volunteers, members of Boards or Commissions, elected or appointed officials.

Definition of Liability Coverage?

Our liability coverage is not an insurance coverage; the State liability coverage is like self-insurance, in that the State of Idaho has a Retained Risk Fund that covers all State entities (including the State Colleges) for liability.

Thus, there is no (primary) liability insurance policy for Lewis-Clark State College (LCSC).  LCSC does have insurance for other types of insurance areas, Property, Inland Marine, Foreign Liability, Excess Liability, etc., but not for the State's primary Retained Risk Liability coverage.

The State's public liability program provides coverage for most claims allowed by the Idaho Tort Claims Act (Idaho Code 6-901 et seq.). A summary of LCSC's liability coverage is as follows:

Description of Coverage

This liability coverage is designed to provide protection to the State (including LCSC) and its employees for money damage claims arising out of negligent acts.

Limits

$500,000 combined single limit per occurrence, as provided by the Idaho Tort Claims Act.
