9 Whereas:
10 universities defines that students should not be charged tuition
11 whereas defined in itself as the cost of instruction.

13 Whereas: On November 5, 2004 the LCSC fiscal year 2006 budget was
14 submitted to the ASLCSC. The proposal included a 9.5%
15 increase in full time resident fees increasing semester costs by
16 $161.00 per student.

18 Whereas: The above stated proposal included a $200,000.00 increase in
19 health benefits for faculty which is an instruction based cost and
20 therefore violates Idaho Code Section 33-3717.

22 THEREFORE BE IT RESOLVED BY THE ASLCSC SENATE:

24 Section 1: The ASLCSC Senate supports the action of a lawsuit against the
25 State Board of Education; not for financial gain, but instead to
26 receive a clear judicial ruling.

28 Section 2: This resolution will pass upon a two-thirds (2/3) vote of the
29 ASLCSC Senate and the signature of the ASLCSC President.
