The materials placed on
reserve by faculty at Lewis-Clark State College must comply
with provisions in the
United States Copyright Act of 1976, Section 107 and the
Family Educational Rights and Privacy Act (FERPA)
of 1974.
Under fair use guidelines, faculty and the library are
permitted to provide students with access to supplemental
materials for coursework. At LCSC, "Fair Use" of
copyrighted material is generally defined as the one time
use of:
1. Single article from
an issue of a periodical or newspaper
2. Single chapter from a
book
3. Short story, essay or
poem
4. Single graphic
representation-chart, diagram, cartoon, illustration
5. Legally acquired
video or music recording
Repeated use extending longer than two
consecutive semesters of an item that is not owned by either
the faculty member or the library requires special
permission from the copyright holder, which the library will
be happy to facilitate using the Copyright Clearance
Center (CCC). When possible, the library will purchase
licensing permission priced at $100.00 or less per item
from the CCC. The item will be placed on reserve while
copyright permission is being obtained, but if permission
is denied by the Copyright Clearance Center, it will be
removed from the reserve collection. All materials
will be removed from Reserve at the end of each term.
